Last year, Dodge quietly and carefully released a recall for certain 2019 and 2020 models of the Dodge Ram 1500. These were the only models affected, but it was a doozy – the flash memory of the Occupant Restraint Controller had a big risk of becoming corrupted, which would disable the airbags and seat belt pretensioners.
This isn’t a funny joke. Numerous Dodge Ram 1500 trucks were at major risk if they got into an accident. Without the pretensioners or airbags, someone could get seriously hurt. But if you were a Dodge Ram 1500 owner affected, could you actually sue Dodge for the risk?
Unless you or a passenger were injured in a crash directly related to this OCR failure, the answer is no. Despite the serious risk that Dodge put thousands of people in without them knowing, there is nothing right now that would allow you to sue for that risk. If you were injured before the recall, you could sue for damages and personal injury, however.
